1. General Terms

2. Area of application

These general terms and conditions are applicable to all agreements and to all legal relationships in which Outspot is the selling party.

Prior to the distance contract being concluded, the text of these general terms and conditions is made available to the consumer. Should such be reasonably possible, it shall be stated prior to the distance contract being concluded that the general terms and conditions are available for perusal at the company and that they shall be sent to the consumer as soon as possible at the request of the consumer. The general terms and conditions can also be saved by the consumer at any time as PDF.

If the distance contract is concluded electronically then, in deviation from the previous paragraph and prior to the distance contract being concluded, the text of these general terms and conditions can be made electronically available to the consumer in such a manner that they can be easily saved on a durable medium. Where such is not reasonably possible it shall be indicated prior to the distance contract being concluded where the general terms and conditions can be electronically perused and that they shall be sent to the consumer at the consumer’s request electronically or by another manner, free of charge.

In the event that, over and above these general terms and conditions, other specific product or services conditions are applicable, then the second and third paragraphs apply by analogy and the consumer can, in the event of conflicting general terms and conditions, always invoke the applicable provision that is most favourable to him/her.

3. Inaccuracies

Outspot is not obliged to fulfil an order nor to compensate any damage suffered by the buyer when it, in presenting the item, has committed an error in the formulation of its properties or in stating its price and i) it ought to have been clear to the buyer that in the case in question a typesetting question was at issue, or ii) when the buyer could not reasonably have relied on Outspot being able to, under the given circumstances, supply that item with those properties at that price or that it could have done so.

4. Safe payments

If the contract is concluded electronically, Outspot takes appropriate technical and organisational measures to secure the electronic transfer of data and it provides a safe web environment. Where the consumer is able to pay electronically, Outspot shall ensure that there are appropriate safety measures in place in that respect.

5. The consumer’s rights

All rights remain under the responsibility of the advertiser. Outspot acts solely as a transaction and marketing channel. In the event of any issues or defects, you can contact the advertiser directly, who shall be responsible for repairs, replacements or compensation, in accordance with your rights.

6. The withdrawal period

6.1. General

You have the right to inform the company that you are declining the purchase without being required to pay a penalty or to state your reasons within 30 calendar days as of the day following the day of the delivery of the item or the conclusion of the services agreement, being the day following the day on which you received your ordered voucher by email.

All requests to cancel the purchase must be made in writing to Outspot (Confinity NV) at helpdesk@outspot.co.uk.

6.2 Exceptions to the right of withdrawal

6.2.1 The right of withdrawal does not apply to personalised products made by the supplier according to your specifications (for example, where your name is stated on a product). The right of withdrawal is likewise not applicable to trips booked online and to tickets for events, concerts, festivals or other such occasions that entail one or more fixed dates.

6.2.2 In the following cases the right of withdrawal is also not applicable. Products that are:

  • made according to your specifications or that are clearly intended for a specific person;

  • perishable or that have a limited shelf life;

  • not suitable for being returned due to health or hygiene reasons and which were unsealed after delivery;

  • the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items;

  • the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, the delivery of which can only take place after 30 days and the actual value of which is dependent on fluctuations in the market which cannot be controlled by the company;

  • contracts where you have specifically requested a visit from the company for the purpose of carrying out urgent repairs or maintenance. If, on the occasion of such a visit, the company provides services in addition to those specifically requested by the consumer or goods other than replacement parts necessarily used in carrying out the maintenance or in making the repairs, the right of withdrawal shall apply to those additional services or goods;

  • the supply of sealed audio or sealed video recordings or sealed computer software which were unsealed after delivery;

  • the supply of a newspaper, periodical or magazine with the exception of subscription contracts for the supply of such publications;

  • contracts concluded at a public auction;

  • the provision of accommodation other than for residential purpose, transport of goods, car rental services, catering or services related to leisure activities if the contract provides for a specific date or period of performance;

  • the supply of digital content which is not supplied on a tangible medium if the contract performance has begun with the consumer’s prior express consent and his acknowledgment that he thereby loses his/her right of withdrawal;

  • contracts for betting and lottery services.

6.3. Refunds during the withdrawal period

If you withdraw from the contract, we will refund all payments made up to that point, excluding delivery costs and in any case no later than 14 days after we have been informed of your decision to withdraw. You will be given the choice between a voucher with additional compensation and a bank transfer to your account. Do you prefer a bank transfer? Then request the conversion of your voucher in your e-mail. A piece of cake! If you only return a part of your order, the delivery costs will not be refunded. We may wait with the refund until we have received the goods back, or you have proved that you have returned the goods, whichever comes first.

7. 100% Money-back guarantee for up to 6 months after purchase (not for products)

Outspot is required by law to comply with a refund period of 14 days for most promotional campaigns. However, within the context of Outspot’s 100% money-back guarantee, we guarantee a 100% refund for up to 6 months after purchase. This can be done by sending a request by letter or email. Enclose the voucher and a copy of your identity card.

This guarantee does not apply to tickets for events, concerts and festivals or trips/other such occasions that entail one or more fixed dates. The guarantee does not apply to the delivery of products either. The guarantee is always clearly stated in the special offers on the website (see the 6 months money-back guarantee). Please note: where the voucher is reserved, used or has expired, the guarantee is void.

Please note: If the purchase has been paid for (in part) with a coupon, the full sum is reimbursed in the form of a coupon. Coupons cannot be combined.

8. Products: service, guarantee or cancellation

You can see which party is responsible for the special offer under ‘Practical information’: Outspot or a partner. The contact details (telephone number and email address) are also listed in that section.

There are various reasons why you could submit a service, guarantee or cancellation request, such as:

8.1. You wish to withdraw from the purchase

You have the right to inform the company that you are declining the purchase without being required to pay a penalty or to state your reasons within fourteen calendar days as of the day following the day of the delivery of the item. Once you have announced your decision to withdraw to the offeror, you have another 14 calendar days in which to return the product.

Do you want to cancel the purchase before the product has been shipped?

You can cancel free of charge. The refund (in the form of a coupon or in cash) shall be paid within 5 days of you exercising your right of withdrawal.

Do you want to cancel after the package has been shipped? (not defective)

Ensure that the following is done:

  • You cancel within 14 days of delivery.

  • The product is returned unused and in its original packaging.

  • The product is complete (including all accessories, instructions, etc.) when it is returned.

Consumables such as batteries, detergents, bulbs and perfumes cannot be returned.

Personal hygiene products such as toothbrushes, razors, trimmers and thermometers cannot be returned.

If your cancellation complies with the above conditions, you can cancel your order. To do so, click on “Practical information” on your voucher. The party responsible for the special offer is listed there.

Outspot is responsible. Send an email to helpdesk@outspot.co.uk containing your voucher code, your name, delivery address and any comments. We strive to respond within 8 hours (on workdays) with clear instructions for returning your product. . You are required to wait for written confirmation from our staff before returning the product. Should you not do so, the costs for returning the product shall be payable by you. If a returned product does not comply with the conditions for cancellation, Outspot shall be unable to process the request. In that event, Outspot shall contact you.

A partner is responsible. Send an email to the partner containing your voucher code, your name, delivery address and any comments. The partner shall inform you how you can return the product. You are required to wait for written confirmation from our partner  before returning the product.

8.2. If you received the product late

Outspot strives to deliver all products within 3 weeks. It could happen that you were unavailable at the time of delivery or that the courier company could not find your address. Don’t worry!

If you have not received your package within 3 weeks of purchase, send an email to helpdesk@outspot.co.uk containing your voucher code and the delivery address you provided. We shall check the shipping status of your package and send you a code that you can use to track it on the courier company’s website. If we cannot obtain a tracking code we shall either send you a new order or, if that is not possible, we shall refund you (in the form of a coupon or in cash).

The product is returned to us when, for example, you were unavailable at the time of delivery or the courier company was unable to find your address. In that event we shall resend your order free of charge to the delivery address provided by you, insofar as that information was correctly provided at the time of the order being placed.

8.3. The product is incomplete, damaged and/or defective at the time of delivery

Our Outspot staff try to pack your order as securely as possible. It is always possible that, when unpacking or assembling your order, you notice that it is defective or that there is a discrepancy.

We recommend that you always check a purchased product within 14 days in respect of the contents, damage or technical defects.

If you note any discrepancies within this period, please inform Outspot or the partner responsible for the special offer (see “Practical information”).

If Outspot is the responsible party, please send an email to helpdesk@outspot.co.uk with your voucher code and a description of the defect or damage, where necessary including photos of the damage.  You are required to wait for written confirmation from our staff before returning the product.

If the damage or defect is clearly visible on the photos, Outspot will immediately offer you a full or partial refund (in the form of a coupon or in cash). This means you are not required to return the product to us.

If the defect cannot be established from the photo, the product must be returned to Outspot. We will email you a shipping label and the instructions for returning the product.

Once Outspot has received your returned product the defect or damage will immediately be inspected. If Outspot establishes that there is damage or a defect it shall first attempt to repair it. If that does not succeed then you shall be refunded (in the form of a coupon or in cash).

Where a partner is the responsible party you are first required to email the partner, stating your voucher code and the nature of the defect or damage, where possible including photos thereof. The partner shall inform you how to return the product.  You are required to wait for written confirmation from our partner  before returning the product.

8.4. The product is defective within the guarantee period

A product supplied by Outspot can be reasonably expected to work. Unfortunately, after time your product could become defective or malfunction. Should that be within the guarantee period provided for by law and fall under the terms and conditions, you can report the issue. You can either inform Outspot or the partner that is responsible for the special offer (see “Practical information”).

Outspot is responsible. If the product becomes defective within the first six months after delivery, Outspot shall send you a shipping label with the necessary instructions. You can then return the product to us and, once we receive it, we shall offer an appropriate solution (exchange, repair or refund).

When the product becomes defective later than six months after delivery, then you are required to return it to Outspot at your own expense. We will then treat the defect with due care and offer you an appropriate solution.

You are always required to wait for written confirmation from our staff or partners before returning the product.

Certain issues are not covered by the guarantee:

  • Water damage

  • Damage as a result of dropping the product or impact

  • Damage caused by inexpert or incorrect use

  • A two-year guarantee that has expired

  • Missing parts

  • Consumables such as bulbs, batteries and liquids

  • Unsealed articles

If your notification does not fall within the guarantee or the terms and conditions, you may be charged inspection costs.

If the guarantee period has expired and your product becomes defective, you can always enquire whether the manufacturer can assist you.

A partner is responsible. Send the partner an email. The partner shall explain the procedure to be followed. You are required to wait for written confirmation from our partner  before returning the product.

When Outspot receives a request for a cancellation, it always strives to solve the issue correctly and within a reasonable period.

Sometimes products cannot be replaced as they are out of stock. If that is the case you shall be refunded in full or in part (in the form of a coupon or in cash).

Please note

During the 14-day cooling-off period you are required to be careful with the delivered product. You have the right to assess the product and try it out, as you might do in a physical shop. For that period where you have not yet decided whether or not you wish to keep the product you may not use it. When you have used the product more than is necessary for the purposes of assessing whether or not you wish to keep it, the product decreases in value. The online retailer is consequently entitled to compensation when you return a used product.
